DEREK WALLACE ENTERS GUILTY PLEAS


Brentwood -  County Attorney Jim Reams announced today that late yesterday afternoon, Derek Wallace of 20 Forrest Street, Salisbury, MA (DOB 11/19/70) entered guilty pleas to three counts of evading state tax charges and Wallace Enterprises plead guilty to attempting to evade NH state taxes as part of a negotiated plea.  Judge Tina Nadeau accepted the guilty pleas from Wallace and his company and will schedule a sentencing hearing as soon as the Pre-Sentence Investigation is completed in approximately 45 days.

 

"The guilty pleas in this case and the results in the other Bayview-related cases have accomplished my goals in pursuing this prosecution: felony convictions, the permanent closing of Bayview Crematory, people are going to jail, the State of New Hampshire has recovered almost $500,000 in taxes, fines and penalties and the State's lax laws regulating crematories have been strengthened", said Reams.  "I have to thank Deputy County Attorney Tom Reid for prosecuting these cases to this successful conclusion. These cases would not have been possible without State Police Detectives Sgt. Richard Mitchell, Trooper First Class Jill Rockey for their tenacious investigation, and the financial analysis and investigation of the financial records of the Bayview related entities by Carol Guyer and John Mintken from Department of Revenue Administration who were assigned to this case.  John Gasaway, an Assistant Attorney General, was also assigned to assist prosecute the case.  We were fortunate enough to have the assistance and cooperation of the Massachusetts State Police and John Bresnahan, from the Massachusetts Board of Licensure.  We thank them for their help. The citizens of this state owe them a debt of thanks for their tenacity and performance", said Reams.

 

"The only part of this case, which began with the arrest of ADME Gino Nigro, remaining is the charges against Kathy Weider, the former employee of the Medical Examiners Office.  We look forward to the scheduling of that case as well", said Reams.
